What is the California Designated Representative training affidavit?

  • The California Designated Representative license application forms are lengthy and involved.  A lot of information needs to be provided, and a lot of documents must be submitted.
  • One document that needs to be submitted is the "Training Affidavit."
  • The training affidavit is one of many forms that makes up the complete license application package.  In order to get a training affidavit, the license applicant needs to go through a training program.  The training program is commonly sold as a training course, training class, or training seminar.  Upon successful completion of a training course, the course administrator issues proof of completion, in the form of a training affidavit.

How To Earn A Training Affidavit

1. Find a training program that is accepted by the California Board of Pharmacy.  We suggest our California Designated Representative training courses.

2. Make sure you take the correct course that's appropriate for your license application.  Specifically, there are several types of California Designated Representative license applications (including, but not limited to):

Training Program For California Designated Representative License Applicants


SkillsPlus International Inc.'s California Designated Representative training courses are accepted by the California State Board of Pharmacy.

California requires drug and device wholesalers to retain a CA-licensed pharmacist or Designated Representative, on-site, to conduct their business. The pharmacist or Designated Representative must be physically present during all hours of operation.

Florida requires Designated Representatives working at drug and device wholesalers to be trained in specific Florida pharmacy laws.

What Is A Pharmacy Designated Representative?

If you're new to the pharmacy world of the Designated Representative, maybe this quick introduction will help. I'm going to explain, using the California (CA) State Board of Pharmacy as the example.

According to the CA Designated Representative application form:
A designated representative is an individual who performs clerical, inventory control, housekeeping, delivery, maintenance, or similar functions related to the distribution or dispensing of dangerous drugs or dangerous devices. To work as a designated representative, you must possess and keep a current certificate as a designated representative.
There are quite a number of requirements that have to be met in order to qualify, including the following training requirements listed on the application form:
Complete a training program that, at a minimum, addresses each of the following subjects:
(A) Knowledge and understanding of California and federal law relating to the distribution of dangerous drugs and dangerous devices.
(B) Knowledge and understanding of California and federal law relating to the distribution of controlled substances.
(C) Knowledge and understanding of quality control systems.
(D) Knowledge and understanding of the United States Pharmacopoeia standards relating to the safe storage and handling of drugs.
(E) Knowledge and understanding of prescription terminology, abbreviations, dosages and format.
The trick then becomes finding a way to fulfill the training program requirement.

Don't Get Caught Without A California HMDR Exemptee

  • Don't get caught without a California Department of Public Health (CDPH) Home Medical Device Retailer (HMDR) Exemptee.
  • It's a wise investment to have more than just one Exemptee, so that you have additional Exemptees for backup and cross-covering.
  • The cost of training another Exemptee is very reasonable, in contrast to having to close down the business.
Here's a free tip:
One of many minimum qualifications to become a California HMDR Exemptee is work experience. Applicants must have one or more years paid experience. Training must have been supervised by a licensed exemptee, Pharmacist-In-Charge or equivalent. No exceptions!

Policies & Procedures Required For CA HMDR Facilities

The CA Home Medical Device Retailer (HMDR) licensing program is governed by law sections found in the California Sherman Food, Drug and Cosmetic Law. The Sherman Law was amended in the 1999-2000 legislative session to establish the HMDR licensing program. The applicable sections can be found in an abstract of the Sherman Law.

Section 111656.3 starts out with:
"Each home medical device retail facility shall have written policies and procedures related to home medical device handling and, if authorized by the department pursuant to Section 111656.4, the dispensing of prescription devices. Those written policies and procedures shall be adequate to assure compliance with this article and shall include, but not be limited to . . . "
Notice the phrase, " . . . shall have written policies and procedures . . . "

I recently attended a conference that included representatives from the European, Asian, and U.S. regulatory agencies. At that meeting there was much discussion around pedigree rules. Some of the concerns expressed begin with importing drugs and bulk actives (now called active pharmaceutical ingredients (APIs)). At this level, manufacturers are required to qualify supplies. This means that a manufacturer must actually visit the API manufacturing site to assure themselves, and the public, that the production facility shown to the auditor is the actual site of manufacture, and that there is no "shadow site" where the real work takes place. Internationally, there are different approaches to the pedigree. In Europe there is exploration with a "book ends" approach. This approach requires the manufacturer to issue the initial pedigree. The next pedigree touchpoint is at the pharmacy when the product is dispensed to the patient. The thinking is that if the product is moving between known distribution channels, then the product is protected. The U.S. requirement is to document every change in ownership. This means that every touchpoint is documented. Yes, regulators in Europe realize that this approach probably provides better assurance of the supply chain. However, they are also concerned about how much work to pass on to the smaller distributors who may not be staffed for this level of documentation.
